These Terms govern your access to Watching Clouds. By accessing or using the game or related services, you agree to these Terms. If you do not agree, do not use the service.
1. Eligibility
You must be legally able to agree to these Terms. If you are below the age at which you can agree on your own where you live, a parent or legal guardian must review and agree to these Terms for you and supervise your use. Do not use the service where doing so is prohibited by applicable law.
2. Platform accounts and access
Watching Clouds may require authentication through Apple Game Center or Google Play Games. You are responsible for your platform account, device security, and activity performed through your access. Platform providers have their own terms, and you must follow them. We may map your verified platform identity to an anonymous internal game ID. You may not sell, transfer, share, or misuse access to your game identity.
3. Community cloud content
The game lets players create procedural cloud snapshots, interpretations, guesses, and related community material (“Community Content”). You retain any rights you have in original Community Content you submit.
By submitting Community Content, you grant Finger Gun a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify for technical or moderation purposes, display, distribute, and otherwise use that content as needed to operate, promote, improve, and provide Watching Clouds. This license lasts while the content is used by the service; anonymized content and results may remain after account deletion as explained in our Privacy Policy.
You represent that you have the rights needed to submit your Community Content and that it does not violate law or another person’s rights. Do not submit personal information, infringing material, harassment, hate, sexual content, threats, dangerous content, spam, or other material inappropriate for the game.
4. Moderation
We may review, filter, restrict, remove, anonymize, or decline to distribute Community Content when we reasonably believe it violates these Terms, platform rules, law, community safety, or the intended experience. We are not required to host any particular content and cannot guarantee that all content will be reviewed. You can report concerns at watchingclouds@fingergun.dev.
5. Fair play and acceptable use
You agree not to:
- cheat, automate play, manipulate scores, leaderboards, statistics, ads, rewards, or matchmaking;
- exploit bugs, interfere with the service, overload systems, bypass limits, or access non-public systems or data;
- reverse engineer the service except where applicable law expressly permits it;
- impersonate others, evade enforcement, or create abusive activity through platform accounts; or
- use Watching Clouds for unlawful, commercial, or harmful purposes not authorized by us.
We may reset scores, statistics, content, or progress where reasonably necessary to correct errors, preserve fair play, or protect the service.
6. Purchases, Premium, and cosmetics
Watching Clouds may offer a one-time lifetime Premium entitlement that removes advertising, as well as optional cosmetic items. Premium is a one-time purchase, not a subscription. Features, pricing, availability, and the contents of Premium or cosmetics may change, subject to applicable law.
Purchases are processed by the relevant app store or platform. Their payment terms apply. Digital items and entitlements are licensed, not sold; are personal and non-transferable; have no cash value; and cannot be exchanged outside mechanisms we expressly provide. “Lifetime” refers to the supported commercial life of the Watching Clouds service, not your lifetime or a guarantee that the service will always be available.
Refunds are handled by the store or platform that processed the transaction, subject to its rules and applicable law. Nothing in these Terms limits refund or consumer rights that cannot legally be limited.
7. Advertising
The free experience may include restrained advertising only between natural transitions, not during active cloud creation or solving. Advertising format, frequency, and availability may change. Premium removes advertising as described at the point of purchase.
8. Finger Gun intellectual property
Watching Clouds—including its software, artwork, branding, interface, game systems, text, and other materials provided by Finger Gun—is owned by Finger Gun or its licensors and protected by intellectual property laws. Subject to these Terms, we give you a limited, personal, revocable, non-exclusive, non-transferable license to use the service for its intended, non-commercial purpose. No other rights are granted.
9. Suspension and termination
You may stop using Watching Clouds at any time and may request account deletion as described in the Privacy Policy. We may suspend, restrict, or terminate access, remove content, or take protective measures if we reasonably believe you violated these Terms, created risk or legal exposure, or threatened the service or its users. Where appropriate, we may provide notice or an opportunity to appeal, but urgent action may occur without advance notice.
Provisions that by their nature should survive termination—including licenses needed for retained anonymized community records, ownership, disclaimers, limits of liability, and dispute-related terms—will survive.
10. Service availability and changes
We may add, remove, test, or change features, content, prices, supported devices, or availability. We may interrupt or discontinue some or all of the service. We do not promise that progress, Community Content, leaderboards, or other records will always be available or recoverable. We will take reasonable steps regarding material changes where required by law.
11. Disclaimers
To the extent permitted by law, Watching Clouds is provided “as is” and “as available.” Finger Gun disclaims implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not guarantee the accuracy, quality, safety, or availability of Community Content. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
12. Limitation of liability
To the extent permitted by law, Finger Gun and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or access arising from Watching Clouds.
These limits do not apply where liability cannot lawfully be excluded or limited, including any mandatory consumer protections that apply to you.
13. Changes to these Terms
We may update these Terms to reflect changes to the game, law, or our operations. We will post updated Terms with a revised date and provide additional notice where appropriate. If you continue using the service after updated Terms take effect, you accept them to the extent permitted by law. If you do not agree, you should stop using the service.
14. General
If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, sale, or transfer of the service. These Terms and the Privacy Policy form the agreement between you and Finger Gun concerning Watching Clouds, except for platform terms that separately apply.
